Terms of Service

Last Updated: July 1st, 2026

These Terms of Service (“Terms”) govern your access to and use of ScottKosch.com (the “Website”), owned and operated by Kosch Media LLC (“we,” “our,” or “us”). The Website is the digital home for Indispensable: A Student’s Guide for Thriving in the Age of AI and provides educational content, resources, a newsletter, an online assessment, and related materials.

Please read these Terms carefully. By accessing or using the Website, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Website.

1. Who Can Use the Website

The Website is intended for users who are 13 years of age or older. By using the Website, you represent that you are at least 13.

If you are under 18, you may use the Website only with the involvement and permission of a parent or guardian, and that parent or guardian agrees to these Terms on your behalf and is responsible for your use of the Website. If you are a parent or guardian permitting a minor to use the Website, you agree to these Terms and accept responsibility for the minor’s activity.

We do not knowingly allow children under 13 to provide personal information through the Website. See our Privacy Policy for details.

If you are using the Website on behalf of a school, district, organization, or other institution, you represent that you have the authority to bind that entity to these Terms, and “you” includes that entity.

2. Educational Purpose — Not Professional Advice

The Website and its content — including the book and its excerpts, articles, guides, downloadable resources, the AI Readiness Assessment, and any other materials — are provided for general educational and informational purposes only.

The content is not professional advice. It is not, and should not be relied on as, career, academic, admissions, financial, investment, legal, medical, psychological, or mental-health advice. Reading our content does not create any professional or advisory relationship between you and us.

You should consult a qualified professional before making decisions based on information you find here. If you are dealing with a mental-health concern or a crisis, please contact a licensed professional or an appropriate support service — our content is not a substitute for professional care.

3. No Guarantees of Outcomes

Our content discusses skills, strategies, and ideas for navigating education and work in the age of AI. We do not guarantee any particular result — academic, career, financial, or otherwise — from reading the book, using our resources, or taking the AI Readiness Assessment. Your outcomes depend on many factors outside our control.

Any testimonials, endorsements, examples, or case studies we share reflect individual experiences and are not a promise that you will achieve similar results.

4. The AI Readiness Assessment

The Website offers an online AI Readiness Assessment (the “Assessment”) for general educational and self-reflection purposes. The Assessment, and any score, profile, or feedback it generates, are informational only. They are not a professional evaluation, diagnosis, aptitude test, or prediction of future performance, and should not be treated as such. The Assessment is hosted by a third-party provider, ScoreApp; your use of it is also subject to ScoreApp’s terms and privacy policy, as well as our Privacy Policy.

5. Intellectual Property

All content on the Website — including text, book excerpts, articles, downloadable guides and resources, the Assessment, graphics, logos, images, design, and the selection and arrangement of that content — is owned by Kosch Media LLC or used with permission, and is protected by copyright, trademark, and other laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Website and its content for your own personal, non-commercial, educational use.

Downloadable resources that we provide specifically for classroom or educational use (such as a classroom companion or educator guide) may be used for those non-commercial educational purposes, consistent with any instructions included with the materials. All other rights are reserved.

Without our prior written permission, you may not:

  • Copy, reproduce, republish, distribute, sell, license, or commercially exploit any content

  • Modify or create derivative works from the content

  • Use the content, in whole or in part, to train, develop, or improve any artificial intelligence or machine-learning model or dataset

  • Remove or alter any copyright, trademark, or other proprietary notices

  • Use any automated means (such as bots, scrapers, or data-mining tools) to access or collect content from the Website

“Indispensable,” “ScottKosch.com,” and related names and logos are marks of Kosch Media LLC or our licensors. If you believe content on the Website infringes your copyright, contact us at the email below.

6. Acceptable Use

You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable law or regulation

  • Interfere with or disrupt the Website, its servers, or networks, or attempt to gain unauthorized access to any part of the Website

  • Introduce viruses, malware, or other harmful code

  • Collect or harvest personal information about other users

  • Use the Website to send spam or unsolicited communications

  • Impersonate any person or misrepresent your affiliation

  • Use the Website in any way that could damage, disable, or impair it, or interfere with another person’s use

We may suspend or terminate your access to the Website at any time, without notice, if we believe you have violated these Terms.

7. User Submissions and Feedback

If you submit content, feedback, comments, testimonials, or other communications to us through the Website or by email, you represent that the information is accurate, that you have the right to provide it, and that it does not violate the rights of any third party or any law.

Unless we agree otherwise in writing, any feedback, suggestions, or ideas you share with us may be used to operate and improve the Website, our content, and our offerings without any obligation or compensation to you. If you provide a testimonial, you grant us permission to use it (including your first name, last initial, and role, such as “student” or “parent”) in connection with the Website and the book, unless you tell us otherwise.

8. Newsletter and Communications

If you subscribe to our newsletter or request resources, you consent to receive emails from us, which may include educational content, book updates, and related messages. You can unsubscribe at any time using the link in any email. Our newsletter and resource emails are delivered through a third-party platform, Beehiiv, and your subscription is also subject to our Privacy Policy.

9. Purchases

Through third-party retailers. The book and related products may be available for purchase through third-party retailers (such as Amazon, Barnes & Noble, Bookshop.org, Apple Books, Audible, and Damn Gravity Media). We do not sell those products directly through the Website and do not process your payment for them. Purchases made through any retailer are governed by that retailer’s own terms, policies, and pricing.

We are not responsible for retailer matters such as payment processing, shipping and delivery, product defects, refunds, returns, or customer service. Any purchase disputes must be resolved directly with the retailer.

Affiliate links. Some links to retailers are affiliate links. If you click an affiliate link and make a purchase, we may earn a commission at no additional cost to you. As an Amazon Associate, we earn from qualifying purchases.

10. Speaking and Institutional Inquiries

You can use the Website to submit inquiries about speaking engagements, workshops, school or institutional partnerships, and bulk orders. Any such inquiry is an inquiry only. Submitting it does not create a binding contract, service agreement, speaking commitment, or partnership obligation. Any formal engagement requires a separate written agreement signed by us.

11. Third-Party Links and Services

The Website contains links to third-party websites, retailers, platforms, and services that we do not own or control. We provide these links for convenience and are not responsible for the content, products, policies, or practices of any third-party site or service. Your use of third-party sites is at your own risk and subject to their terms and privacy policies.

12. Disclaimer of Warranties

The Website and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the Website will be uninterrupted, secure, or error-free, that defects will be corrected, or that the content is accurate, complete, or current. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, Kosch Media LLC and Scott Kosch will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Website or its content.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Website or these Terms will not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Kosch Media LLC and Scott Kosch from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Website, your violation of these Terms, or your violation of any law or the rights of any third party.

15. Privacy

Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the Website, you consent to the practices described in the Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Website after changes are posted means you accept the revised Terms. If you do not agree to the changes, please stop using the Website.

17. Changes to the Website

We may modify, suspend, or discontinue any part of the Website at any time, including content and resources, without notice or liability.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Website will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts. Before filing any claim, you agree to first contact us at the email below and attempt to resolve the dispute informally and in good faith.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a business transfer. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Website.
